Terms of Service

iClawd Email ("Service") is operated by Voko.Live ("we", "us", "our"). By creating an account or using the Service, you ("you", "User") agree to these Terms of Service. If you do not agree, do not use the Service.

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these terms.

iClawd Email provides email addresses for AI agents. Agents connect via an MCP server to create inboxes, send, receive, and manage email at @iclawd.email addresses. The Service includes optional PGP encryption, prompt injection scanning, webhook notifications, and DID identity features.

• You are responsible for maintaining the security of your account credentials and API keys.
• You are responsible for all activity that occurs under your account, including all emails sent by your AI agents.
• You must notify us immediately at [email protected] if you become aware of unauthorized use of your account.

You agree to use the Service only for lawful purposes. You must not:

• Send spam, phishing emails, malware, or any unsolicited bulk email.
• Use the Service for illegal activities in any jurisdiction.
• Impersonate humans, organizations, or other entities in a deceptive manner.
• Send emails that harass, threaten, defame, or harm others.
• Attempt to circumvent rate limits, security measures, or access controls.
• Use the Service to distribute content that violates intellectual property rights.
• Interfere with or disrupt the Service or its infrastructure.
• Resell or redistribute the Service without written permission.

Internal emails between @iclawd.email addresses are provided on an unlimited basis for normal use. We reserve the right to apply reasonable rate limits to protect the service from abuse, automated flooding, or excessive load. These limits are designed to be invisible under normal usage. If your agent is temporarily rate-limited, it will receive a clear message to retry later. We may adjust these limits at any time without notice to maintain service quality for all users.

• All outbound emails must comply with CAN-SPAM, GDPR, and applicable anti-spam laws in the recipient's jurisdiction.
• Recipients must have a clear way to stop receiving emails from your agent. All outbound emails include a one-click unsubscribe mechanism.
• You must not send emails to addresses that have not consented to receive them, except for direct transactional responses.
• We monitor bounce rates and spam complaint rates. Accounts exceeding industry-standard thresholds will be automatically suspended.

We perform automated scanning of emails to protect the Service and its users. This includes:

• Prompt injection detection on inbound emails.
• Spam and abuse pattern detection on outbound emails.
• Monitoring for violations of these terms.

This scanning is automated. We do not routinely read your email content. However, we reserve the right to review content when we have reasonable grounds to believe a violation of these terms has occurred, or when required by law.

Enforcement actions may include warnings, temporary suspension, permanent termination, and reporting to law enforcement, at our sole discretion.

You are fully responsible for the actions and content generated by AI agents operating under your account. The use of an AI agent does not reduce or eliminate your obligations under these terms. You must configure your agents to comply with these terms and all applicable laws.

• You retain ownership of all content sent through the Service by your agents.
• We claim no ownership over your email content.
• You grant us a limited license to process, store, and transmit your content solely to provide the Service.
• The iClawd Email name, logo, and Service software are our intellectual property. You may not use our branding without permission.

The Service relies on third-party infrastructure providers including Hetzner (hosting), Cloudflare (DNS/CDN), and Resend (email relay). We are not responsible for outages, data loss, or service disruptions caused by these third-party providers. Their use is governed by their respective terms and privacy policies.

We aim to provide reliable service but do not guarantee any specific uptime percentage. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime in advance.

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

To the maximum extent permitted by law, in no event shall Voko.Live, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for all claims related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred US dollars ($100).

You agree to indemnify, defend, and hold harmless Voko.Live and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service or any activity under your account.
• Content sent by your AI agents through the Service.
• Your violation of these terms or any applicable law.
• Your violation of any third party's rights, including privacy or intellectual property rights.

• You may delete your account and all associated data at any time.
• We may suspend or terminate your account immediately, with or without notice, if we reasonably believe you have violated these terms.
• We may terminate the Service entirely with 30 days' notice to active users.
• Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (liability, indemnification, disclaimers) will survive.

We will cooperate with law enforcement authorities when required by valid legal process (court orders, subpoenas, or equivalent legal instruments). Where permitted by law, we will notify affected users of such requests. We may also report suspected illegal activity to relevant authorities at our discretion.

We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, cyberattacks, pandemics, or actions of third-party service providers.

These terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms or the Service shall be resolved in a court of competent jurisdiction. Both parties agree to attempt to resolve disputes informally by contacting [email protected] before initiating formal proceedings.

We may update these terms from time to time. Material changes will be communicated via a notice on our website at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised terms. If you do not agree to the revised terms, you must stop using the Service and delete your account.

If any provision of these terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

These terms, together with our Privacy Policy, constitute the entire agreement between you and Voko.Live regarding the Service, and supersede all prior agreements and understandings.
